Terms of Service

Effective date: 9 July 2026 ยท These terms govern the CAFETERIA operator subscription and account portal.

These Terms of Service ("Terms") are a legal agreement between you ("you", "operator", or "your venue") and CAFETERIA ("CAFETERIA", "we", "us", or "our"), located at 1887 Whitney Mesa Drive, Henderson, Nevada. By creating an account, starting a trial, or subscribing to the CAFETERIA service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

CAFETERIA provides an adaptive-audio application for hospitality venues that adjusts in-venue music to reduce noise build-up, together with an operator account portal for managing your subscription and the tablets ("devices") on which the app runs. We may improve, change, or discontinue features over time.

2. Research Measurement and Control Periods

CAFETERIA rests on a claim that no published research has established: that adjusting background music reduces the noise people make. Rather than assume it, the app tests it during normal operation, and you should know what that means for your venue.

  • Control periods. On a random fraction of the moments when the app would otherwise adjust your music โ€” currently about one moment in seven โ€” it measures the room and makes no adjustment. Without these there is no way to distinguish an adjustment that worked from noise that was already subsiding on its own.
  • Measurement sweeps. Periodically the app lowers the music by roughly four decibels over about twenty seconds, holds briefly, and returns it over about sixteen seconds, while measuring how the room responds. The rate of change is slower than the volume adjustments the app already makes in ordinary use, and is intended to pass unnoticed.

No audio is recorded, stored, or transmitted during either. What is collected is the anonymized operational data described in our Privacy Policy, with each period labelled so control periods can be separated from adjusted ones during analysis. Which moments are selected is random and unpredictable in advance, by design.

Control periods can be switched off remotely, without an app update. If you have questions, or do not wish your venue to take part, contact us at the address in Section 14.

3. Free Trial

New installations receive a 30-day free trial, issued automatically the first time the app runs on a device. No credit card is required to start the trial. The trial is tied to the device that started it and provides full functionality up to the device cap described in Section 7. When the trial period ends, continued use requires a paid subscription.

4. Subscription & Billing

The CAFETERIA operator subscription is $9.99 per month, billed monthly in advance. Payments are processed by our payment provider, Stripe. You authorize us (through Stripe) to charge your payment method the subscription fee, plus any applicable taxes, for each billing period. Prices may change on prior notice; changes apply to the next billing period.

5. Automatic Renewal

Your subscription renews automatically each month and your payment method is charged $9.99 (plus applicable taxes) at the start of every billing period, until you cancel. You may cancel at any time as described in Section 6 to stop future renewals.

6. Cancellation

You can cancel your subscription at any time โ€” self-service from your account in the portal, or by contacting us at hello@cafeteria.la. Cancellation takes effect at the end of the current billing period: your access and licensed devices continue to work until that date, and you will not be charged again after it.

7. License & Devices (Seats)

A paid subscription grants you a limited, non-exclusive, non-transferable license to run the CAFETERIA app on up to five (5) tablets at your venue at one time. Each active device occupies one seat on your license; you can deactivate a device from your account to free a seat for another tablet. The license is valid only while your subscription is active and in good standing, and is revoked on cancellation or non-payment.

8. Refunds

Subscription fees are non-refundable except where a refund is required by applicable law. We do not provide partial-month or pro-rated refunds for unused time. Because you can cancel at any time to prevent the next charge, and because a 30-day free trial is available before any payment, we do not issue refunds for a billing period already begun. This does not limit any non-waivable rights you may have under the law of your jurisdiction.

9. Acceptable Use

You agree not to: (a) resell, sublicense, or share your license or account except as permitted here; (b) circumvent the device cap or any technical protection; (c) reverse-engineer, decompile, or tamper with the app except as permitted by law; (d) use the service unlawfully or in a way that harms CAFETERIA or others. We may suspend or terminate accounts that violate these Terms.

10. Service Availability & Disclaimer

The service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or that it will achieve any particular acoustic result in your venue. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. The app measures and adjusts audio; it is not a safety device or a substitute for professional acoustic assessment.

11. Limitation of Liability

To the maximum extent permitted by law, CAFETERIA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

12. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Nevada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date and, where required, communicated to you. Your continued use of the service after a change takes effect constitutes acceptance of the updated Terms.
